Digital Messaging Company (“DMC”, “we”, “us”, “our”) is committed to protecting your personal data and being transparent about how we use it. This policy explains what information we collect, why we collect it, how it is used, and the rights you have over it. 

We operate in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. DMC is the data controller for all personal data collected through this website, by email, via telephone, and through online or offline forms.

Privacy & Cookies

1. What Personal Data We Collect

Depending on how you interact with us, we may collect and process the following types of personal data: 

  • Identity data — your name and job title 
  • Contact data — email address, telephone number, and company name 
  • Business data — your industry, project requirements, and company details relevant to providing our services 
  • Communications data — the content of your enquiries, emails, or messages to us 
  • Technical data — IP address, browser type and version, pages visited, and session duration, collected via our website and analytics tools 
  • Marketing preferences — your opt-in or opt-out status for marketing communications 
  • Transaction data — details of products or services purchased or quoted for 

 

We do not collect any special categories of personal data (such as health, religious, or biometric data), and we do not knowingly collect personal data from individuals under the age of 18. 

2. How We Collect Your Data

Online contact and enquiry forms 

When you complete a contact form, demo request form, or any other online enquiry form on our website, we collect the details you provide. This typically includes your name, email address, job title, telephone number, and company name. 

Offline forms 

We may also collect personal data through paper-based forms at events, exhibitions, site visits, or as part of the sales process. Information collected offline is handled with the same care and under the same lawful bases as data collected through our website. 

Email correspondence 

When you email us, we retain the content of that correspondence along with any personal data it contains, such as your name, contact details, and the nature of your enquiry. This information is used to manage your enquiry and any resulting business relationship. 

Website browsing 

When you visit our website, certain technical data is collected automatically through cookies and analytics tools (see Sections 6 and 7). This includes your IP address, browser details, pages visited, and time spent on the site. 

3. Why We Collect and Use Your Data

We only collect and process personal data where we have a valid lawful basis to do so under UK GDPR. The lawful bases we rely on are as follows: 

  • Contractual necessity — to fulfil an order, provide a product or service you have requested, process a quote, or manage your account 
  • Legitimate interests — to operate and improve our business, communicate with existing or prospective customers about relevant products and services, perform due diligence, and ensure the security of our systems and data 
  • Legal obligation — to comply with applicable laws and regulations, including tax, fraud prevention, and financial record-keeping requirements 
  • Consent — where you have actively opted in to receive marketing communications from us 

 

In all cases, your personal data will only be used for the specific purposes it was collected for, as described in this policy. We will not use your data in a manner that is incompatible with those purposes. 

4. How Long We Retain Your Data

We retain personal data only for as long as is necessary for the purposes for which it was collected, or as required by law. 

  • Enquiry and contact form data is retained for as long as needed to manage your enquiry and any resulting business relationship, typically up to six years in line with standard commercial record-keeping practice 
  • Email correspondence is retained in line with our internal data management schedule, and for as long as necessary to support any ongoing business relationship 
  • Website comments, if approved and published, are retained indefinitely so that follow-up comments can be recognised and moderated automatically 
  • User account data, where an account is registered on this website, is retained until you request deletion or close your account 
  • Marketing preferences are retained for as long as we maintain a marketing relationship with you, or until you withdraw consent or opt out 

 

When personal data is no longer required, it is securely deleted or anonymised. 

5. Who We Share Your Data With

We take your privacy seriously and will not sell or rent your personal data to any third party. 

In limited circumstances, we may share your data with: 

  • Trusted service providers acting as data processors on our behalf — for example, our email marketing platform (Mailchimp), website hosting provider, and IT security contractors. These parties are contractually bound to process your data only in accordance with our instructions and to maintain appropriate security measures 
  • Analytics providers — Google Analytics processes anonymised technical data to help us understand how our website is used (see Section 7) 
  • Relevant third parties for marketing purposes — where you have not opted out of marketing communications, we may share your contact details with carefully selected partner organisations whose products or services we believe may be of genuine relevance and value to you. Any such third party is required to comply with UK GDPR and applicable data protection law, and you will always be able to opt out of their communications directly 
  • Professional advisers — including legal, financial, or insurance advisers, where reasonably necessary for the operation of our business 
  • Regulatory authorities — where we are required to do so by law, regulation, or court order (for example, HMRC or the Information Commissioner’s Office) 

 

We will never authorise a third party to use your personal data for their own unrelated purposes, and we do not permit any processor to further share your data without our express consent. 

6. Marketing Communications and Your Right to Opt Out

We may contact you from time to time with information about our products, services, case studies, and industry news. We will only do this where: 

  • you have given us your explicit consent to receive marketing communications; or 
  • you are an existing customer and we are contacting you about products or services similar to those you have previously purchased or enquired about, in line with the Privacy and Electronic Communications Regulations (PECR) 

 

You can opt out of marketing communications at any time by clicking the unsubscribe link in any email we send you, or by contacting us directly at marketing@digital-messaging.com or calling 020 3393 1470. We will process all opt-out requests promptly. 

Opting out of marketing will not affect any transactional or service-related communications that are necessary in connection with an active order, project, or contract. 

If you would prefer that your contact details are never shared with third parties for marketing purposes, please let us know and we will record this preference on your account. 

7. Google Analytics

We use Google Analytics to monitor how visitors interact with our website. This helps us understand which pages are most useful, how people navigate the site, and where we can make improvements. Google Analytics collects anonymised technical data including your IP address (which is truncated and not stored in full), browser type, device type, pages visited, and session duration. 

This data does not identify you personally. It is processed by Google on our behalf and governed by Google’s privacy policy, available at policies.google.com/privacy. 

You can opt out of Google Analytics tracking across all websites by installing the Google Analytics Opt-out Browser Add-on, available at tools.google.com/dlpage/gaoptout. 

8. Mailchimp (Email Marketing)

Where you have opted in to receive marketing communications, or where we are contacting you as an existing customer about relevant products and services, we may use Mailchimp to manage and send those emails. Mailchimp stores your name and email address on our behalf under a Data Processing Agreement that ensures your data is handled securely and in compliance with UK data protection law. 

Your data is never used by Mailchimp for their own marketing purposes. Mailchimp’s privacy policy is available at https://www.intuit.com/privacy/statement/. 

You can unsubscribe at any time using the link in any email we send, or by contacting us directly. 

9. Cookies

Cookies are small text files stored on your device when you visit a website. We use cookies to ensure our website functions correctly and to collect anonymised data about how it is used. 

Essential cookies 

These cookies are necessary for the website to function and cannot be switched off. They include cookies that store your cookie consent preferences and session management cookies used when you log in to the site. These do not contain personal data and are discarded when you close your browser, or expire after a defined period. 

Analytics cookies (Google Analytics) 

These cookies allow us to count visits and understand how visitors move around the website. All data collected is anonymised. These cookies are only set with your consent. 

Comment and preference cookies 

If you leave a comment on our website, you may opt in to saving your name, email address, and website address in cookies for your convenience, so you do not need to re-enter them next time. These cookies last for one year. 

Login cookies 

If you have a registered account on this website and log in, we set cookies to maintain your login session. Login cookies last for two days; if you select “Remember Me”, this extends to two weeks. Screen preference cookies last for one year. These are removed when you log out. 

Managing cookies 

You can control and manage cookies in your browser settings at any time. Please note that disabling certain cookies may affect the functionality of this website. You can also manage your preferences through our cookie consent tool, which appears when you first visit the site.

10. Embedded Content from Other Websites

Some pages on this website may include embedded content — such as videos, images, or feeds — from third-party platforms. Embedded content behaves in exactly the same way as if you had visited the third-party website directly. Those websites may collect data about you, set their own cookies, and monitor your interaction with the content. We recommend reviewing the privacy policies of any third-party platform whose embedded content you interact with. 

11. Website Media and Images

If you upload images to this website, please ensure they do not contain embedded location data (EXIF GPS data). Visitors can download images from the website and extract any location data they contain. We are not responsible for any personal data embedded in uploaded media files. 

12. Security

We take the security of your personal data seriously. Measures we have in place include: 

  • An active SSL certificate to encrypt data transmitted between your browser and our website 
  • Access controls to ensure personal data is only accessible to authorised personnel 
  • Regular review of our digital security practices with the support of professional IT contractors 

 

In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, we are obliged under UK GDPR to notify the Information Commissioner’s Office (ICO) within 72 hours of becoming aware of it, and to inform affected individuals where required.

The right to be informed — you have the right to know how and why we process your personal data. This policy fulfils that obligation. 

The right of access — you can request a copy of the personal data we hold about you (a Subject Access Request). 

The right to rectification — you can ask us to correct inaccurate or incomplete personal data. 

The right to erasure — you can ask us to delete your personal data where there is no compelling reason for us to continue holding it. This right does not apply where we are required to retain data for legal or contractual purposes. 

The right to restrict processing — you can ask us to pause the processing of your personal data in certain circumstances. 

The right to data portability — where we process your data by automated means on the basis of your consent or a contract, you can request that we provide it to you in a structured, machine-readable format. 

The right to object — you have the right to object to processing based on our legitimate interests, including the use of your data for direct marketing. We will stop processing your data for marketing purposes immediately upon receiving your objection. 

Rights related to automated decision-making — we do not carry out automated decision-making or profiling that produces legal or similarly significant effects on individuals.
